Testamentary discretionary trusts
A testamentary discretionary trust is a trust that is created within your Will and does not take effect until after you die.
Incorporating a testamentary discretionary trust in your Will provides significant flexibility, tax minimisation and asset protection for those who will benefit from your estate. Asset protection becomes particularly important for your beneficiaries who are (or may later become) at risk and/or vulnerable.
