A testamentary discretionary trust is a trust that is created within a person’s Will and does not take effect until after they die.

Incorporating a testamentary discretionary trust into a Will can provide significant flexibility, tax minimisation and asset protection for beneficiaries of the estate. Asset protection becomes particularly important if your client has beneficiaries who are (or may later become) at‑risk and/or vulnerable.
